In accordance with section 64 of the Anguilla Air and Sea Ports Authority (AASPA) Act and section 3(1)(a) of the Seaports Regulations, notice is hereby given to all boat owners, whose boat(s) (fishing, commercial or otherwise) is/are moored in the Sandy Ground Harbour between the main cargo port’s jetty and the Marine Base jetty (police jetty), that the boats are to be removed from the defined area to accommodate the following races which were previously postponed:
Sunday, 19th April – Festival Del Mar – A Class Sunday, 26th April – James Ronald Webster – B Class
All vessels must vacate the above defined area one day before each race. Below are excerpts from the aforementioned legislation as the AASPA will be strictly enforcing the law.
Section 64 of the AASPA Act:
Power of Chief Executive Officer
64. (1) Notwithstanding the provisions of any regulations made under section 86 the Chief
Executive Officer may—
(a) direct where any ship or aircraft shall be berthed, moored, anchored or parked, and the method of anchoring of ships and parking of aircraft within a port and the approaches to a port;
(b) direct the removal of any ship or aircraft from any berth, station, anchorage or position to another berth, station, anchorage or position, and the time within which such removal is to be effected, within a port and the approaches to a port; and
(c) regulate the movement of ships and aircraft within a port and the approaches to a port.
(2) In case of any refusal or neglect or of any failure to comply with any direction given under subsection (1), the Authority may, without prejudice to any proceedings being instituted against any person, cause to be done all such acts as are in its opinion reasonable or necessary for the purpose of carrying out such direction and may hire and employ such persons as it considers proper and necessary for such purpose.
(3) All expenses incurred in doing such acts shall be paid and borne by the person or persons so offending.
Section 3(1)(a) of the Seaports Regulations states:
General control
3. (1) the Chief Executive Officer—
(a) has general control and direction over every person or ship entering or remaining in a port area;
